Whilst every assistance is given by this Agency in the agreement of terms of an engagement, the engagement and contract of employment are the sole responsibility of the Employer. The Agency can, however, in the case of Nannies provide a specimen contract of employment on request.

Any travelling expenses should be agreed prior to interview or engagement where applicable.

Unless the Applicant is self-employed, the Employer should ensure that Income Tax and National Insurance contributions are deducted from the salary and forwarded to the Inland Revenue, either by you or by an established payroll company, ie. Way2paye or Nannytax.

The fees charged by this Agency become payable upon engagement, ie. when the Applicant introduced through the Agency has formally accepted the position offered by the Employer. This does not mean the actual date of commencement of employment.

Should, for some reason, an Employee is found to be unsuitable and an Employer wishes to terminate the employment the following conditions will apply:-

The Agency agrees to refund an Employer in full if an Applicant fails to take up his/her appointment after an engagement has been effected.

Should an Employee leave your employment within eight weeks it is our policy to provide a replacement free of charge. The Agency must be given up to one month from the date of termination to provide a replacement. If, during this period, the Client makes alternative arrangements and/or requests “No replacement” no refund will be given. We will only offer one replacement free-of-charge. In the case of Au Pairs, please be aware that we cannot always guarantee the length of time that the replacement will stay. Nor can we guarantee to have the same nationality available.

If, however, it proves impossible for the Agency to effect a suitable replacement within one month the following refunds will apply after an administration fee of £75 has been deducted:-

TERMINATION WITHIN WEEK 1 100%
TERMINATION WITHIN WEEK 2 100%
TERMINATION WITHIN WEEKS 3 and 4 50%
TERMINATION WITHIN WEEKS 5 and 6 30%
TERMINATION WITHIN WEEKS 7 and 8 20%

THE ABOVE REFUNDS APPLY ONLY WHEN OUR ACCOUNT HAS BEEN PAID WITHIN TEN DAYS OF THE INVOICE DATE AND IF THE EMPLOYER [OR HOST-FAMILY IN THE CASE OF AN AU PAIR] HAS TREATED THE APPLICANT FAIRLY AND IN THE CASE OF RESIDENTIAL STAFF INCLUDING AU PAIRS HAS PROVIDED ADEQUATE ACCOMMODATION. OUR REFUND POLICY DOES NOT APPLY IN RESPECT OF SUMMER AU PAIRS ALTHOUGH A FREE REPLACEMENT WILL ALWAYS BE OFFERED.

The Agency cannot be held responsible for the replacement or refund of any Au Pair/Mother’s Help/Nanny who has cause to cancel or terminate a position because of war, terrorism, civil disturbance or International pandemic.

Clients retaining the services of the Employee, however unsatisfactory, to suit their own convenience will be liable for the Agency fee in full for the period the Employee is retained. If a Client introduces an Au Pair/Motherrsquo;s Help/Nanny/Babysitter to another family and an engagement is made, the Client will be liable for the full fee. Any Client found to be employing [by direct means] an Employee previously interviewed or who has previously worked for the Client on a temporary or part-time basis shall be liable to pay the appropriate introduction fee for the new arrangement taking into account any increase in the hours of work.

Whilst every care is taken to introduce suitable candidates the final responsibility as to whether they should be offered the position must, of course, rest with the Employer. The Agency cannot be held responsible for any loss, damage, clash of personalities arising out of any introduction, nor do they give any guarantee concerning the history, character, capability or suitability of any Employee introduced by the Agency. Clients must satisfy themselves in this respect. You are the Employer of a Nanny or Motherrsquo;s Help and you must ensure that your household insurance policy provides employerrsquo;s liability cover in respect of a child-carer working in your home.

IMPORTANT NOTE REGARDING AU PAIRS REQUIRED TO DRIVE. Should you require your Au Pair to drive, please be aware that he or she will be used to driving on the right. This Agency advises Hosts to take their Au Pair for sufficient driving practice to ensure safety. If you are in any doubt, please ask an established driving school, such as BSM, to take your Au Pair out for a lesson to assess her skills. This Agency cannot be held responsible for the Au Pairrsquo;s standard of driving or for any incidents or accidents that occur while your Au Pair is driving your car. Please remember to take out motor insurance for your Au Pair.

NOTE: In the case of an Au Pair placement the term “Employer” should read “Host Family” and the term “Employee” should read “Au Pair”. Please read attached legal updates regarding Au Pair holidays.
